Contrary to popular belief, the seat of arbitration does not refer to the geographical
location of the arbitration hearings or the venue of the arbitration hearings.


The seat of arbitration refers to the legal place of the arbitration, that is, the place
that determines the procedural framework of the arbitration. The seat of arbitration
determines which country’s procedural law will apply to the various aspects of the
arbitration including rights of appeal/challenges, interim remedies and the extent to
which local courts will support or supervise the arbitration (such as the
implementation of the New York Convention.
